Negotiating, structuring and managing contracts
​​ABOUT THE COURSE

Delivered by a practising commercial solicitor with extensive experience in training, this course focuses on the terms of the contract and identifies the key provisions. It is not a standard negotiation course; we will not be examining your personal negotiating style etc, though we will be exploring negotiation issues in the context of negotiating the wording and scope of contractual provisions. We will also be assessing understanding of risk and liability and identifying what terms and conditions will protect your position and help achieve your contracting goals and objectives. We will consider how contracts can be structured. We will also focus on contract management issues to ensure that the contract words as it should.

COURSE OBJECTIVES

It is essential for anyone involved in negotiating or managing contracts to have an understanding of the key terms that are needed in order to achieve the commercial objectives of the deal.  It is, of course, important to understand the deal from the outset and the rationale for entering into the contract. It is then crucial that you identify and mitigate any areas of risk and liability.  You should focus on the key provisions such as scope and responsibility and ensure that you understand what the consequences are should the other side or you not perform the contract in accordance with its terms. 

Managing is contract is important. Are you certain that you are performing the contract and have systems in place to identify problems and instances of poor or non-performance by the other side? What provisions should be included in the contract to help ensure compliance with its terms?  And how does the contract provide for change management?  You will identify the danger areas where a failure to act when faces with a variation in performance could have significant consequences. 

We will also have time for questions and discussion to ensure that any particular issues and queries that you may have, and that may be specific for your industry, are addressed.​

We do not currently have any dates scheduled for this course. We do, however, offer this course in-house. The rate for an in-house course is £2200 plus vat per day (£4400 should you wish to book the two day course).
